DRAFT, in-house review, not legal advice. Prices, evaluation length and refund terms are proposed and await owner approval (decision "Commercial terms"). Items marked To be completed must be completed before publishing.
These Terms are an agreement between you and Aithnography LLC, an Idaho limited liability company ("we", "us"), which operates Math on Cue. By creating an account you accept these Terms and our Privacy Notice, including the Children's Privacy Notice.
1. Who can use Math on Cue
- Accounts are for adults. You must be at least 18 and the parent or legal guardian of each child you add. At signup you confirm that you are.
- Children use Math on Cue only through a parent's account, under a nickname profile you create after giving consent. You are responsible for supervising your children's use and for activity in your account.
- Math on Cue is offered for use in the United States. To be completed confirm.
2. Your account
You sign in with a one-time code sent to your email. Keep your email account and your devices secure, and use the parent PIN on devices your children use. Tell us promptly if you think someone else has accessed your account.
3. The 7-day evaluation
- After you give consent for your children, your family gets one free 7-day evaluation with up to 4 child profiles. No payment card is needed.
- The evaluation does not turn into a paid plan automatically. When it ends, practice pauses until you choose a plan. Your children's progress is kept, subject to the time limits in the Children's Privacy Notice.
- One evaluation per family.
4. Plans and prices

Prices are in US dollars, plus any applicable sales tax. Every plan includes all four operations (adding, subtracting, multiplying, dividing), adaptive review, voice or typed answers, and parent progress reports. Voice answers use your device's own speech recognition; cloud voice minutes are not currently offered. Adding a child beyond your plan's limit is never charged automatically. You choose a plan change yourself.
5. Automatic renewal: please read
Your subscription renews automatically until you cancel.
- What you'll be charged: the plan price shown at checkout ($7.99, $12.99, $59.99 or $99.99), plus tax, every month or every year, depending on what you chose. The first charge happens when you subscribe; renewals happen on the same date each period.
- How it's charged: website purchases are charged by Stripe to the payment method you entered. App-store purchases are charged by Apple or Google to your store account.
- How to cancel:
- Website purchases: Parent space → Manage plan, which opens the Stripe customer portal. You can cancel online at any time, with no phone call needed. You can also email us.
- App Store purchases: iPhone/iPad Settings → your name → Subscriptions → Math on Cue.
- Google Play purchases: Google Play → Payments & subscriptions → Subscriptions → Math on Cue.
- Deleting your family account cancels a website subscription immediately. It does not cancel an app-store subscription; cancel that in the store.
- When cancellation takes effect: your plan stays active until the end of the period you've already paid for, and it does not renew. Except as described in section 6, we do not give partial refunds for unused time.
- Price changes: we will email you at least 30 days before a new price applies to your renewal. You can cancel before then. App-store price changes follow Apple's or Google's rules, which may include asking for your agreement.
- Reminders and confirmation: after you subscribe, we email a confirmation with these terms and how to cancel. We email a reminder before each yearly renewal. To be completed implement: subscription confirmation email with cancellation instructions, and a renewal reminder 7–30 days before yearly renewals. Stripe's built-in receipts alone may not meet state auto-renewal laws (for example California's). Verify current state requirements.
- Failed payments: if a renewal payment fails, access continues for up to 7 days while the payment is retried. After that, practice pauses until payment succeeds.
6. Refunds
- Website purchases (Stripe): if you're not satisfied, ask us within 14 days of a charge and we will refund that charge in full. To be completed Hank to approve the scope: every charge, or only the first charge and yearly renewals. A full refund ends access right away, and the subscription will not renew.
- App Store and Google Play purchases: we can't issue these refunds. Apple or Google decide them under their own policies: Apple through reportaproblem.apple.com, Google through Google Play's refund request. If the store refunds or revokes a purchase, access ends.
- Where the law gives you more rights, those rights apply.
7. Acceptable use
Please don't:
- share your account outside your household, resell access, or use Math on Cue for a school or business without our written agreement;
- put real names, contact details or other personal information in nicknames;
- try to access another family's information, get around the parent gate, consent, plan limits or security, or interfere with the service;
- copy, scrape or reverse-engineer the service or its content, except as the law allows;
- use the service in a way that breaks the law.
We may suspend or close accounts that break these rules. Except where safety or the law requires otherwise, we will tell you first and let you download your family's data.
8. Educational purpose and limits
Math on Cue is a practice tool for building quick recall of arithmetic facts. Our tagline, "Know the facts cold. Make room for harder math.", describes what the practice is for. It is not a promise of results.
- We do not guarantee any learning outcome, grade, test score or rate of progress. Results vary from child to child.
- Progress labels such as "fluent" follow the rules described in the app. They are not a formal assessment.
- Math on Cue is not a diagnosis, assessment or treatment for any learning difference, disability or medical condition (including dyscalculia or attention difficulties). It does not replace a teacher, tutor, school, or medical or educational professional. If you have concerns about your child's learning, please talk to a qualified professional.
- Speech recognition can mishear. We ask again when an answer is unclear, and typing is always available. Some misrecognized answers may still be recorded.
9. Our content and your data
We (and our licensors) own the app, the practice content and the audio. You may use them for your family's personal, non-commercial practice while your account is active. We use your family's information only as described in the Privacy Notice, and you can download or delete it at any time.
10. Changes to the service and these Terms
We may improve or change Math on Cue. If we remove a core feature you pay for, we will tell you, and you may cancel and ask for a prorated refund of a website purchase. When we change these Terms in a way that matters, we will email you at least 30 days before the change takes effect and update the version above. If you keep using Math on Cue after that, the new Terms apply. If you don't agree, you can cancel.
11. Ending your account
You can delete your family account at any time in Parent space. We may end the service or your account with reasonable notice. If we end the service for reasons other than your breach of these Terms, we will refund the unused part of any prepaid website subscription.
12. Disclaimers
Math on Cue is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted or error-free, or that speech recognition will work on every device or for every voice.
13. Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data;
- our total liability for any claim about Math on Cue is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
Some states don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability that the law does not allow to be limited.
14. Disputes and governing law
These Terms are governed by the laws of the State of To be completed Hank to choose, normally the state where Aithnography is organized and applicable US federal law. Before filing a claim, please contact us so we can try to resolve it informally within 30 days. You may bring a claim in small-claims court where you live or in the courts of To be completed county and state. [Note: this draft deliberately has no arbitration clause or class-action waiver. Adding one should be a deliberate decision, ideally with counsel.]
15. App-store terms
If you downloaded Math on Cue from the App Store or Google Play, that store's terms also apply to your purchase. Apple and Google are not parties to these Terms and are not responsible for the app or its support. To be completed if publishing on iOS without a custom EULA, Apple's standard EULA applies; confirm the App Store Connect license setting.
